Firework Control Zones Privacy Notice

Why are we collecting personal information?

The Fireworks and Pyrotechnic Articles (Scotland) Act 2022 gives local authorities powers to designate Firework Control Zones. In doing so, local authorities must have regard to any guidance issued by the Scottish Ministers. The “Firework control zones: guidance for local authorities” states that, where possible, communities should be given the opportunity to request the designation of a firework control zone.

The processing of community requests for Firework Control Zones is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in North Ayrshire Council. The information that you are asked to provide when making a community request is required to enable the local authority to process your application.

What personal information do we require?

North Ayrshire Council’s Firework Control Zone community application process requires the following information to be collected in respect of the Lead Applicant:

  • name
  • full postal address (including postcode)
  • email address
  • contact telephone number
  • details of community that they are a member of
  • where relevant, any opinions they choose to provide

In addition, the application requires the following information to be collected in respect of signatories supporting the application:

  • name
  • address
  • the nature of their interest in the application

What is the lawful basis for processing this information?

North Ayrshire Council is the data controller for the processing of the personal data and is reliant upon:

  • Article 6, 1, (e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

The Fireworks and Pyrotechnic Articles (Scotland) Act 2022 and the “Firework control zones: guidance for local authorities” sets out the framework for local authorities processing community requests for the designation of Firework Control Zones.

Who is my personal information shared with?

Your information may be shared with:

  • council departments – Connected Communities, Protective Services, Estates, Legal, Streetscene, Education and Audit, Fraud, Safety and Risk
  • Elected members – Cabinet and/or Audit & Scrutiny Committee
  • Police Scotland - as a consultee
  • Scottish Fire and Rescue Service - as a consultee

Anonymised data may be shared with the Scottish Government for statistical and research purposes.

Personal information may also be required to be shared by law with other parties.

If you respond to a consultation on a proposed Firework Control Zone then any personal information you provide will be shared with relevant Council departments and elected members.

Is information made available to the public?

Your personal information will not ordinarily be made available to the public. However, it may be possible for others to identify you from information you have provided which appears in Cabinet or Audit and Scrutiny Committee papers.

How long will my personal information be stored for and is it secure?

Personal information will be stored for three years from the date the Firework Control Zone community request application is refused, or for three years from the date that any Firework Control Zone resulting from your application is revoked. Your data will be stored securely on Council systems and only viewed by those who have a lawful requirement to access it.
