An assignation is when you give your tenancy to another person in your household (known as the assignee) and take your name off the tenancy. You can still remain in the property.

You may want to hand over your tenancy if you want to move out or would rather someone else was responsible for the tenancy. To qualify for assignation, the following must have been the case for at least 12 months before you apply:

you must have been the tenant
the person taking over the tenancy must have been living with you
we must have been notified that the person was living with you

You will hand over all your rights and responsibilities to the other person.

Any council tenant can submit an assignation form.

The tenancy will not be handed over until we have given permission and the new tenant has completed their part of the application form.

If you hand over your tenancy, you don’t have to move out. However, you will no longer have the same rights you did as a tenant. If you assign your home to someone else, they have the right to hand it on again.

The submission of the form does not mean that the application has been successful. Housing office staff will review the submitted application and confirm if your application has been successful or not.

The first part of the submission is completed by you (the tenant) and the second part of the form is completed by the proposed assignee. Once the assignee's application has been received, we aim to have reviewed and submitted the outcome of your request within 20 working days.

Before starting your application, you will need:

a registered MyAccount where you will have access to complete the Assignation application form
an email address that we will use to contact you about the status of your application
email address for the assignee (once you have submitted your part of the application, the second part will automatically send to the assignee using this email address)
proof of ID (valid driving licence, valid passport, birth certificate, marriage certificate, national insurance number card, medical card, recent utility bill, valid UK residency permit, European Economic Community (EEC) identity card)
proof of residency (valid driving licence, utility bill, bank statement, wage slip, Department for Work and Pensions (DWP) correspondence); we can only accept proof of residency letters dated within the last 3 months of the date you submit your application
proof of consent if other parties have occupancy rights granted by the court to the property that you are requesting to assign to another person (see our assignation consent form template or contact your local Housing office for a copy of the form to be sent to you)
